  15.  This file, LICENSE, describes the terms and conditions by which 
  16.  Silver Creek Entertainment will license other parties to distribute this software 
  17.  program which is intended solely for distribution as "shareware" (the "Game") No use, 
  18.  reproduction or distribution of the Program, or of copies of the Program, is authorized 
  19.  except in compliance with the terms and conditions set forth below.

  23.  =============== The key  points to our LIMITED DISTRIBUTION RIGHTS ===============

  27.       Individuals can, and are entirely encouraged! to give away copies of the Game
  28.       without charge.  You are NOT allowed to give your registration code to others or 
  29.       make it possible for others to play the full game, not excluding hacks or patches.  
  30.       You are only allowed to play the full game if you get a registration code from 
  31.       Silver Creek Entertainment.

  33.       Online services (including BBSs, and WWW and FTP sites) that
  34.       are free (except for any subscription fees or incidental
  35.       Internet access charges), and BBSs may make the Game
  36.       available for downloading.

  38.  *ALL* OTHER DISTRIBUTION, including by
  39.  CD-ROM, shareware catalog, or retail rack REQUIRES:

  41.         WRITTEN PERMISSION (WHICH SILVER CREEK ENTERTAINMENT MAY WITHHOLD IN   
  42.         ITS DISCRETION) &

  44.         PRE-PAYMENT OF A LICENSE FEE OR OTHER MUTUALLY AGREED BENEFIT.

  47.  DISTRIBUTION OTHERWISE IS PROHIBITED BY LAW AND INFRINGES RIGHTS OF

  50.  Claims against violators will be pursued.

  52.  ======================= LICENSE ============================
  53.  [1]  DEFINITIONS: 
  54.       The "Trademarks" consist of the "Silver Creek Entertainment" 
  55.       words and logo, the name of the Game, game characters, and all other marks 
  56.       used by Silver Creek Entertainment in connection with the Game.  Other 
  57.       trademarks used for description or comparison purposes are the property of 
  58.       their respective owners.
  59.  
  60.  [2]  OWNERSHIP:
  61.       Except to the extent expressly licensed, Silver Creek Entertainment
  62.       owns and reserves the exclusive right to distribute the Game, and the right to use
  63.       the Trademarks in connection with it.  Its content, layout and format are
  64.       the property of Silver Creek Entertainment to the extent permitted by law.

  66.  [3]  GRANT:
  67.       Silver Creek Entertainment grants a non-exclusive, non-transferable, 
  68.       royalty-free license to distribute the Game only as follows:
  69.  
  70.   [A] INDIVIDUALS are encouraged to share and give copies of the Game to
  71.       friends, family, coworkers, and members of any not-for-profit
  72.       organization, but only without charge.
  73.  
  74.   [B] ONLINE SERVICES (including BBSs, and WWW and FTP sites) that are free
  75.       (except for any subscription fees or incidental Internet access charges),
  76.       and BBSs may make the Game available for downloading.
  77.  
  78.   [C] These grants are subject to the conditions that no copyright information
  79.       or trademark will be added or removed, and all of the Game's files as
  80.       released by Silver Creek Entertainment will be included without modification .
  81.      The only file you may distribute is:

  83.              hws_200_68K.sit.hqx approx 3.2 megs
  84.  
  85.       which is a self-extracting file containing game files & may NOT be uncompressed and 
  86.        repackaged.

  88.   [D]  *ALL* other distribution, including by lease, rental, online service
  89.      that charges for online access time, CD-ROM, catalog, and retail rack REQUIRES WRITTEN
  90.      PERMISSION (which Silver Creek Entertainment may withhold in its discretion) AND 
  91.      PRE-PAYMENT OF A LICENSE FEE OR OTHER MUTUALLY AGREED BENEFIT.     
  92.      Interested persons are invited to contact Silver Creek Entertainment (proposals are 
  93.      welcome).

  95.  [4]  TERM: 
  96.       
  97.       Unless terminated for cause, grants by Silver Creek Entertainment under this
  98.       LICENSE.DOC terminate 30 days after receipt of written notice, or such
  99.       longer period as the notice may provide.  Sections [2], and [5]
  100.       survive termination.

  102.  [5] LIMITED WARRANTY AND LIMITATION OF REMEDIES:  THE GAME IS 
  103.       PROVIDED "AS-IS", AND NO WARRANTIES OF ANY KIND (INCLUDING IMPLIED 
  104.       WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE),
  105.       EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. UNDER NO 
  106.       CIRCUMSTANCES WILL WE PROVIDE ANY REMEDY FOR DIRECT, INDIRECT, 
  107.       SPECIAL,  CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING
  108.       FROM IT,  INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF
  109.       WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH
  110.       DAMAGES.

  112.  [6]  MISCELLANY
  113.     [A] Since we (Silver Creek Entertainment ) would be irreparably damaged if 
  114.       Sections [2], [3], or [6][D] were not specifically enforced, we will be 
  115.       entitled without bond, other security or proof of damages, to appropriate equitable
  116.       remedies with respect to breaches of such sections, in addition to such 
  117.       other remedies as we may have.
  118.  
  119.   [B] You will indemnify and hold us, our partners, affiliates, contractors,
  120.       employees and agents harmless from damage, loss and expense arising
  121.       directly or indirectly from your acts and omissions in copying,
  122.       distributing or modifying the Game.
  123.  
  124.   [C] With respect to every matter arising under this, you consent to the
  125.       exclusive jurisdiction and venue of the state and federal courts sitting
  126.       in Oregon, and to service by certified mail, return receipt
  127.       requested, or as otherwise permitted by law.
  128.  
  129.   [D] You will not modify the Game.
  130.       Except to the extent, if any, applicable law may require otherwise, you
  131.       will not decompile, disassemble, or reverse engineer the Game, or use or
  132.       disclose any confidential information that it contains.

  134.  This version of the license.doc supercedes any previous versions of said
  135.  document relating to the Game.
